Recent research reviewing Family Court cases involving domestic and family violence (DFV) and child sexual abuse (CSA) found: • Mothers who raised allegations of DFV and CSA were less likely to obtain custody than fathers, despite the high number of allegations against fathers. • Independent Children's Lawyers (ICLs), appointed to represent children's best interests in the court, overwhelmingly supported the parent accused of abuse. • In 60.3% of cases reviewed, children were ordered to live with the parent accused of DFV and/or CSA, following support from the ICL The link between domestic and family violence and child sexual abuse is well established and re-confirmed in this study. These findings are concerning, particularly when considered alongside the prevalence of child sexual abuse in Australia as identified in the Australian Child Maltreatment Study, which found that the issue was widespread with 28.5% of Australians experiencing child sexual abuse. For decades, systemic concerns have been raised about the Family Court’s response to CSA matters, including that the Court lacks the power to investigate abuse allegations and must rely on child protection agencies and police, which too often fail to investigate and hold offenders to account. QSAN advocates for urgent reforms to ensure that children’s safety comes first and that these reforms must be informed and led by victim-survivors of CSA and DFSV, as well as experts in child sexual abuse and sexual violence. QSAN were in attendance yesterday for the announcement by the Attorney General, the Honourable Deb Frecklington MP, for the establishment of the Queensland Protection Commission. We welcome greater information sharing, coordination and investment in child safeguarding and the protection of children from sexual abuse and hope this new agency will be able to identify patterns of abuse earlier, including grooming behaviour and act pre-emptively, as promised. We are disappointed however, that Recommendation 12 of the In Plain Sight Report, which recommended improved specialist support services for children and families, has not been immediately actioned and only accepted in principle. Specialist sexual violence services for children in Queensland, especially those under 12 years, are chronically under-funded and geographically limited and if victim survivors are truly a priority, this needs to change. We eagerly await the budget next week to see if this recommended funding is supported. QSAN has also consistently called for greater investment in prevention, early intervention, evidence-based research, and survivor led strategies. We also once again call for the Queensland Government to engage with us and other relevant stakeholders in the development of a whole of government and community plan to end sexual violence in Queensland that adopts a holistic response to the issue.
